A BOC‑3 (Designation of Agents for Service of Process) is an official filing with the FMCSA that designates a process agent in each state upon which the motor carrier, broker, or freight forwarder operates, as per 49 CFR 366. A process agent is a person or company authorized to receive legal documents, such as lawsuits, court summons, or official legal notices, on behalf of the business.
The FMCSA requires all MC number holders to obtain a processing agent in every state to act as a reliable legal representative available to receive official legal documents if a carrier is involved in a legal proceeding. This is a federal requirement and is NOT OPTIONAL.
A BOC‑3 is required when applying for a new U.S. DOT Operating Authority (MC Number), reinstating operating authority after it has been revoked if the prior BOC‑3 is no longer valid, changing to a different process agent company (a new BOC‑3 must be filed), or when there have been updates to the company's legal name.
The BOC‑3 is filed by a blanket process agent on behalf of the carrier. The FMCSA only allows authorized BOC‑3 companies to act as a processing agent.
